Terms of Service

1. Acceptance of Terms

By accessing or using the Svarnac platform ("Service"), you agree to be bound by these Terms. These Terms constitute a binding legal agreement between you ("User") and the operators of Svarnac ("We," "Us"), based in Bengaluru, Karnataka, India. If you do not agree, you may not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Eligibility (Age Restriction)

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with any and all applicable laws and regulations.

3. User-Generated Content & License

Svarnac is a hosting platform. We claim no ownership over the content you create.

• Your Ownership: You retain full copyright and ownership rights to any articles, stories, or content you post.
• License to Us: By posting content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, display, distribute, modify (for formatting purposes), and promote your content on Svarnac.
• Right to Delete: You may delete your content at any time. Upon deletion, we will cease displaying it publicly, though caching, backups, or archives may retain copies for a limited period for technical reasons.
• Feedback: If you choose to provide input and suggestions regarding problems with or proposed modifications or improvements to the Service ("Feedback"), then you hereby grant Svarnac an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to exploit the Feedback in any manner and for any purpose.

4. Copyright & Takedowns

We respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information at support@svarnac.com:

• A description of the copyrighted work that you claim has been infringed;
• A description of where the material is located on the Service (e.g., the URL);
• Your contact information (email address).

We reserve the right to remove content alleged to be infringing without prior notice and at our sole discretion.

5. Account & Security

• Authentication: You are responsible for safeguarding your Google or GitHub credentials. We are not liable for unauthorized access to your account.
• Termination: We may suspend or terminate your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Prohibited Conduct

You agree not to use Svarnac to:

• Post content that is illegal, defamatory, pornographic, or promotes hate speech.
• Infringe on the intellectual property or privacy rights of others.
• Scrape, hack, or disrupt the Service’s infrastructure.
• Distribute viruses, malware, or other harmful computer code.

7. Indemnification

You agree to defend, indemnify, and hold harmless Svarnac and its operators from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right. This defense and indemnification obligation will survive these Terms and your use of the Service.

8. Disclaimer & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

To the maximum extent permitted by Indian law, in no event shall Svarnac or its operators be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data (e.g., lost drafts), use, or goodwill.
• Technical Failures: Any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Service by any third party.
• Third-Party Links: Any content or links posted by users that direct to third-party websites. We do not endorse or assume responsibility for any third-party sites or services.

Liability Cap: Our total liability for any claim arising out of or relating to these Terms or our Service, regardless of the form of the action, is limited to the greater of:

• The amount paid by you to use the Service in the 12 months preceding the claim; or
• ₹1,000 (One Thousand Indian Rupees).

9. Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference), acts of God, heavy weather, flood, fire, war, riots, terrorist attacks, or failure of third-party service providers (e.g., cloud hosting or database failures).

10. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

11. General

• Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Entire Agreement: These Terms constitute the entire agreement between you and Svarnac regarding the use of the Service.
